ACDP Court Bans Vaccine for Teens Threatens Students’ Rights to Equality

Section 27 deplored the African Christian Democratic Party’s (ACDP) injunction against distributing vaccines to teenagers as a risk jeopardizing students’ rights to equality, access to health care and basic education.

Section 27 reaffirmed its position on Tuesday that it would join the fight in support of the Ministry of Healthdecision to vaccinate adolescents and adolescents against Covid-19.

The organization has filed with South Africa’s Supreme Court, Pretoria’s Gauteng Branch, the main arguments in support of the government’s rollout of Covid-19 vaccines for children aged 12 to 17.

The African Christian Democratic Party (ACDP) has raised objections to the ministry’s plan to roll out vaccinations targeting teenagers.

The case brought by ACDP and their partners against the National Department of Health and the South African Health Products Regulatory Authority (SAHPRA) will be heard in open court before Judge Potterill.

Section 27 intervenes like amicus curiae (friend of the court), to provide the court with information on the adverse impact of Covid-19 on the educational, social and mental health of students and their experience of schooling over the past two years,” spokeswoman Yulia Chaskalson said.

“Now that schools have fully reopened with no rescheduling, it is critical to allow adolescent vaccinations to continue so that students attending schools with poor and overcrowded infrastructure are protected from the worst effects of Covid-19.

“Together with other non-pharmaceutical interventions such as ventilating and wearing masks, vaccines are critical to protecting young people from Covid-19 outbreaks while in school.

“We believe that any attempt to prevent the distribution of vaccines to adolescents risks compromising students’ rights to equality, access to health care, basic education, and section 28(2) of the Constitution, which states that the best interests of the child are paramount. importance in every matter concerning the child.

National Department of Health and Sahpra oppose the ACDP application and, in their papers, “demonstrated clear scientific evidence for the safety and efficacy of the Pfizer Covid-19 vaccine in adolescents.”

Chaskalson said the organization believes immunizations should be made more accessible to young people, not put on hold as ACDP and their partners hope.

“Moving into the winter months, when the chances of a re-emergence of the corona virus are more likely, the ACDP’s proposed vaccine ban for teens could be disastrous – not just for students themselves, but for entire school communities.”
